PharmLink Website Terms and Conditions

These Website Terms & Conditions should be read in conjunction with our Privacy Policy, available on our website and in conjunction with the Pharmacy Terms & Conditions, or Provider Terms & Conditions which are available upon creation of an account, or if you have an existing account they are located under Terms & Condition when you log into our Portal.

1. INTRODUCTION

These Website Terms and Conditions (Terms) govern your use of the Pharmlink Pty Ltd (ACN 685 419 318) (we, us, our) website located at www.pharmlink.com.au (Website). By accessing or using this Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Website.

2. USE OF WEBSITE

You may only use this Website for lawful purposes and in accordance with these Terms. You must not use this Website in any way that causes, or may cause, damage to the Website or impairment of the availability or accessibility of the Website.

You agree not to use the Website:

  • In any way that breaches any applicable laws or regulations;
  • To engage in any fraudulent activity;
  • To copy, transmit, distribute, store or otherwise use or process any information for a commercial purpose without our prior written consent.

3. RETURNS POLICY

  • To the extent required by law, refunds will be issued for faulty Goods only.
  • We do not issue credits.
  • If a Good is not refunded in accordance with clause 10.1, and we deem that it is a faulty Good, then we will issue a replacement Good in lieu of the faulty Good.
  • We do not provide exchanges.
  • Refunds are also not generally available for change of mind Orders or general dissatisfaction with a Good that is not attributable to a fault.
  • Without limitation to clause 10.5, if there has been an unexpected situation (for example an accidental Order has been placed), we will endeavour to accommodate the return, but acceptance of such a request is at the discretion of us and/or the Connected Pharmacy.
  • If a return is accepted in accordance with clause 10, it must meet the following criteria:
    • it has been less than 20 business days since the Order was placed;
    • the Good is in original, unopened packaging, with no damage, and is in resalable condition;
    • the Good is not marked “Not Returnable” on the PharmLink Portal;
    • the Good is not a special Order or new product request (e.g. such as custom sizes, specialist continence, enteral feeding, or nutritional products);
    • the Good does not require specialised storage (e.g., refrigeration);
    • the Good has at least 30 days of shelf life remaining before expiry;
    • the Good was ordered through the PharmLink Portal;
    • the Good is returned to the Pharmacy or Supplier; and
    • the Provider must pay a restocking fee, which includes:
      • the cost of pickup, and
      • return delivery to the Pharmacy or Supplier.

4. SHIPPING & DELIVERY

A delivery fee may be charged by a Connected Pharmacy for home deliveries. The Provider acknowledges that Delivery Fees and Rates are set at a flat rate fee of $10.00 and are included in the Net Order Value. If you’re outside the Pharmacy’s delivery area, they will contact you to discuss options.

A variable fee applies for delivery of specific products that need to be shipped directly to Clients. You’ll be notified of these fees, before they are charged.


5. INTELLECTUAL PROPERTY

Unless otherwise stated, we or our licensors own the intellectual property rights in the Website and all material on the Website. All these intellectual property rights are reserved.

You may view, download, and print pages from the Website for your own personal use, subject to the restrictions set out in these Terms.

You must not:

  • Republish material from this Website;
  • Sell, rent or sub-license material from the Website;
  • Reproduce, duplicate, copy or otherwise exploit material on our Website for a commercial purpose;
  • Edit or otherwise modify any material on the Website.

6. ACCOUNT REGISTRATION & SECURITY

Where access to certain parts of the Website requires account registration (e.g. the Pharmlink Portal), you must:

  • Provide accurate, current and complete information during the registration process;
  • Keep your account information secure, including any username or password; and
  • Notify us immediately of any unauthorised access or use of your account.

You are solely responsible for all activities that occur under your account.


7. AVAILABILITY OF WEBSITE

We reserve the right to change, suspend or discontinue any aspect of the Website, including the availability of any features, information or content, at any time without notice.

We do not guarantee that the Website will always be available or that access will be uninterrupted. We may suspend, withdraw, discontinue or change all or any part of our Website without notice.

8. THIRD PARTY LINKS

This Website may contain links to other websites owned and operated by third parties. We have no control over the contents of those websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Your use of third-party websites will be governed by the terms and conditions and privacy policies of those third parties.

To the maximum extent permitted by law, we do not make any warranties or representations about this Website or the materials appearing on it, including:

  • That the content is accurate, complete or current;
  • That access to the Website will be uninterrupted or error-free; or
